Equipment Rental Agreement

Rental Conditions

By renting equipment from PBJ Lights and Sound, the Renter agrees to the following conditions:

  1. Responsibility for Equipment
     The Renter is fully responsible for all rented equipment from the time it leaves PBJ Lights and Sound possession until it is returned and inspected. Loss, theft, or damage—regardless of fault—is the responsibility of the Renter.
  2. Proper Use
     All equipment must be used in a safe, lawful, and appropriate manner. The Renter agrees not to alter, misuse, or allow unqualified individuals to operate the equipment.
  3. Return Condition
     Equipment must be returned clean, complete, and in good working order. A cleaning or repair fee may apply if equipment is returned in poor condition. If equipment is returned in broken or unusable condition replacement will be 100% of new item replacement costs along with 20% restocking fee.
  4. Late Returns
     Late returns will incur additional daily rental fees unless previously arranged. Equipment not returned within 7 days after the due date may be considered stolen and subject to legal action. Items not returned will be charged at 100% new replacement value with 20% restocking fee.
  5. Cancellation Policy
  • No-shows on the day of rental: No refund.
  • Cancellation within 24hr prior to rental date will be charged a 10% fee.
  1. No Warranty
     PBJ Lights and Sound makes no warranties, express or implied, regarding the performance or fitness of the rented equipment. The Renter assumes all risk related to the equipment’s use.
  2. Indemnification
     The Renter agrees to indemnify and hold harmless PBJ Lights and Sound and its employees against any liability, claims, or expenses arising from the use or misuse of the rented equipment.
  3. Technical Support & Setup
     Unless specifically contracted, PBJ Lights and Sound does not provide on-site technical support or setup. Instructions will be provided if requested.
  4. Weather Policy
     Equipment must not be used in rain, snow, or excessive wind unless it is rated for such conditions. Renter assumes liability for weather-related damage.
  5. Insurance & Permits (if applicable)
     The Renter is responsible for obtaining any necessary permits, licenses, or insurance for the use of rented equipment at public events.
  6. The rental period and associated costs are determined by the rental duration selected at the time of booking on the PBJ Lights and Sound website or rental platform. The Renter acknowledges that:The start and end dates/times selected during the online reservation define the rental period.The rental fee is based on the selected duration, and additional fees may apply for early pickup or late return.Any extension of the rental period must be requested in writing and approved by PBJ Lights and Sound in advance, and may incur additional charges.By completing the booking, the Renter agrees to the specified terms and cost structure outlined in their digital rental summary per item.
  1. Legal Eligibility & Jurisdiction

The Renter affirms that they are at least 18 years of age and legally authorized to enter into binding rental agreements in the State of Tennessee. In the event of any dispute, claim, or legal action arising from this agreement or the use of rented equipment, the parties agree that venue shall be exclusively in the courts of Washington County, Tennessee, or the nearest appropriate federal court serving Washington County. The Renter agrees that this Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.

  1. Payment Authorization & Identification

The Renter authorizes PBJ Lights and Sound to charge the credit card on file for any of the following:Outstanding rental fees, Late return penalties, Replacement costs for lost, stolen, or irreparably damaged equipment. Cleaning or repair fees for equipment returned in substandard condition. Extended rental charges if the equipment is not returned by the agreed date and time.The Renter agrees that this authorization remains valid for up to 15 business days after the equipment is returned, to allow for inspection and billing of any damages or overages.

  1. A valid government-issued photo ID (e.g., driver’s license, passport) must be presented by the Renter (or authorized agent) at the time of pickup or delivery. PBJ Lights and Sound reserves the right to refuse the release of equipment if proper identification is not provided and recorded.
